The South Africa Kashmir Action Group (SAKAG), in collaboration with the Muslim Lawyers Association (MLA), has officially lodged a criminal complaint against Indian Prime Minister Narendra Modi, calling for his investigation, arrest, and prosecution for alleged international crimes committed in India-Illegally Occupied Jammu and Kashmir (IIOJK).
The complaint, submitted to the South African Police Service (SAPS), the National Director of Public Prosecutions (NDPP), and the Directorate for Priority Crime Investigation (DPCI), accuses Mr. Modi and his administration of crimes against humanity and grave breaches of international humanitarian law. The legal action coincides with Modi’s visit to South Africa for the G20 Summit in Johannesburg.
Attorney Tayob of the MLA confirmed that SAPS has acknowledged receipt of the complaint, with Captain Matlhabe confirming steps toward consultation with the National Prosecuting Authority for further investigation.
The complaint, anchored in both South African constitutional provisions and international law, highlights serious violations of the Geneva Conventions, the Universal Declaration of Human Rights (UDHR), the International Covenant on Civil and Political Rights (ICCPR), and the Rome Statute of the International Criminal Court (ICC).
The complainants emphasize that South Africa’s Constitution—particularly Sections 231 to 233—requires respect for international law and upholding of human rights principles in domestic interpretation. They argue that the South African government has both a legal and moral obligation to act, consistent with the nation’s long-standing stance against oppression and apartheid.
SAKAG Chairman Salman Khan underscored that war crimes and crimes against humanity are universally condemned acts that demand accountability from all responsible nations. He stated that South Africa must not become a refuge for alleged perpetrators of such crimes, as doing so would compromise the country’s moral authority and global standing.
The complaint serves as a call for justice on behalf of the victims in Kashmir who, according to SAKAG and MLA, have suffered systemic repression and violence under the Modi administration. The groups assert that accountability for international crimes is a global responsibility and that justice, though delayed, must never be denied.
The filing is supported by multiple international human rights reports, including those from the United Nations, Human Rights Watch, and Amnesty International, all documenting ongoing human rights abuses in Kashmir.
